NOTICE FOR BIH AIRSPACE USERS - A NEW PROCEDURE FOR CHANGING THE ORGANIZATION AND STRUCTURE OF THE AIRSPACE IN FIR SARAJEVO WAS ADOPTED

Users of BiH airspace are informed that a new "Procedure for changing the organization and structure of airspace in FIR Sarajevo" has been adopted among Bosnia and Herzegovina Air Traffic Management Committee with the prior consent of the Ministry of Communications and Transport of BiH, the Ministry of Defense of BiH, Bosnia and Herzegovina Directorate of Civil Aviation (BHDCA) and Bosnia and Herzegovina Air Navigation Services Agency (BHANSA) at its 72. session held on 08th November 2022. An integral part of the procedure is the form: "Request for approval of the change in the organization and structure of the airspace in FIR Sarajevo with Instructions for creating a risk assessment for the change in the organization and structure of the airspace in FIR Sarajevo".

The request for approval of the change in the organization and structure of the airspace in FIR Sarajevo along with the risk assessment is submitted to the BHDCA. Along with the request and risk assessment, the applicant submits proof of payment of the administrative fee for the request and decision, in the amount of 5.00 BAM and 15.00 BAM, in accordance with the instructions published on the official website of the BHDCA.

BHDCA considers the request and the submitted documentation and, if necessary, leaves the applicant a deadline for supplementing the request and/or submitting the documentation.

If BHDCA determines that the request is well-founded, it will be submitted together with the documentation to BHANSA, which will be submitted an opinion on the impact of the proposed change on the safety of air navigation and the provision of services in air navigation.

BHDCA considers BHANSA's opinion, prepares a draft decision which, together with the file, is submitted to the Bosnia and Herzegovina Air Traffic Management Committee for further proceedings.

The Committee considers the draft decision and the submitted file and makes a recommendation to the BHDCA for the adoption of a decision on approving the request, with the consent of the Ministry of Communications and Transport of BiH and the Ministry of Defense of BiH. In the event that the Ministry of Defense of Bosnia and Herzegovina and/or the Ministry of Communications and Transport of Bosnia and Herzegovina do not give their consent to the draft of the Decision, the Committee organizes a special thematic session taking into account the reasons for not giving consent and the submitted request, for the purpose of analyzing the reasons for the lack of consent and making recommendations to the institutions involved in the procedure. In case of impossibility of agreement, the Committee informs BHDCA, which acts in accordance with the law governing the administrative procedure of the Institutions of Bosnia and Herzegovina.  

If the Ministry of Communications and Transport of BiH and the Ministry of Defense of BiH agree to the recommendation of the Committee, BHDCA will issue a decision approving the change in the organization and structure of the airspace in FIR Sarajevo, which will be delivered to the applicant and the originator, for publication in the Aeronautical Information Publication of BiH - AIP BiH. 

If the Ministry of Communications and Transport of BiH and the Ministry of Defense of BiH give their consent, BHDCA will issue a decision on the rejection of the request, against which the applicant will have the right to appeal, which will be submitted to the Ministry of Communications and Transport of BiH via BHDCA within 15 days from the date of the decision. 

The procedure for changing the organization and structure of the airspace in FIR Sarajevo is published in the "Official Gazette of Bosnia and Herzegovina" and on the official website of the Ministry of Communications and Transport of BiH, Ministry of Defense of Bosnia and Herzegovina, BHDCA and BHANSA.
